1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Bloomplots-AI writer ("we," "us" or "our"), concerning your access to and use of the Bloomplots website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
2. Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us.
User Generated Content Ownership:
You retain full ownership of the stories, characters, and text you generate using Bloomplots-AI writer. We do not claim copyright over your creations. By using the Service, you grant us a license to host and process your content solely for the purpose of providing the Service to you.
3. User Representations
By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Service; (4) you are at least 18 years old, or the age of legal majority in your jurisdiction, and you will not use the Service to create sexualised content involving minors.
4. Acceptable Use Policy (Strictly Enforced)
Bloomplots is a tool for fictional creative writing. We have a zero-tolerance policy for abuse. You agree NOT to use the Service to:
- Generate realistic images or deepfakes of real people (including celebrities, politicians, or private individuals).
- Generate sexually explicit content, NSFW or suggestive imagery, non-consensual sexual content (NCII), or child sexual abuse material (CSAM).
- Generate hate speech, harassment, or content that promotes violence.
- Use the API as an open-ended general purpose chatbot for companionship or roleplay outside of the context of story writing.
Every image prompt is screened against this policy before generation. Violation of this policy will result in immediate account termination without refund. See our full Acceptable Use Policy for details.
5. Subscriptions and Payments
Billing: You may purchase a paid subscription directly from Bloomplots-AI writer by paying a subscription fee in advance on a monthly basis or some other recurring interval disclosed to you prior to your purchase.
Payment Processor: Our order process is conducted by our online reseller Creem. Creem is the Merchant of Record for all our orders. Creem provides customer service inquiries and handles returns.
Cancellation: You can cancel your subscription at any time by logging into your account. Your cancellation will take effect at the end of the current paid term.
Refund Policy: We offer a 14-day money-back guarantee for subscription purchases if you are not satisfied with the service. Please contact xu250618@icloud.com to request a refund. Refunds are issued by Creem, our Merchant of Record, back to your original payment method.
6. Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
